If you do not agree with any of the Terms and Conditions, do not accept them and do not continue to use the Website or App, or enter any Competitions or Skill Competitions or use the Software.

TERMS & CONDITIONS
The following Terms and Conditions apply to your use of the Website and App, including all Competitions that are available via our Website and/or App. Please read them carefully to make sure you fully understand their content. By using this Website/App, creating a User Account or entering a Competition, you accept these Terms and Conditions and agree to be bound by them.

If you do not agree with any of the Terms and Conditions, do not continue to use the Website or App, create a User Account, or enter any Competitions.

Definitions

  1. There are certain words and phrases that are used throughout these Terms and Conditions which have specific meanings (these are known as defined terms). Users can identify defined terms because they start with capital letters (even if they are not at the start of a sentence). Where a defined term is used anywhere in these Terms and Conditions, it has the following meaning:
    • App means the PrizeStars App, to be available on both iOS and Android platforms.
    • Applicable Law means the laws of the United Kingdom that are applicable to these Terms and Conditions and the Website and App, as amended and in force from time to time.
    • Assistance Programs means any artificial intelligence including, without limitation, ‘robots’ and/or any other computer generated program used to interact with the Software in aid or in place of a player.
    • Bonus Competition has the meaning given to it in term 39.
    • Closing Date means the date on which a Competition closes, as specified in the description of the Competition on the Website or App.
    • Competition means a Prize Draw Competition, Skill Competition or Bonus Competition.
    • Correct Result means the x-axis and y-axis co-ordinates calculated by the Skill Competition Algorithm for any particular Skill Competition Picture in a Skill Competition.
    • Draw means the random selection from all valid PrizeStars Tickets for any given Prize Draw Competition to determine the Winner and, where applicable, any Runner(s) Up of a Prize Draw Competition.
    • Draw Date means the date at which the Draw takes place following the Closing Date of the relevant Prize Draw Competition.
    • Entrant means any natural person (not including a limited company, partnership or limited liability partnership) who validly submits an Entry or a Postal Entry (where relevant) to a Competition, in accordance with these Terms and Conditions.
    • Entry means a validly submitted and completed entry by the Entrant through the Website or App in order to gain an opportunity to win a Prize in a Prize Draw Competition or Skill Competition.
    • Entry Fees means the fees payable in respect of an Entry.
    • Intellectual Property Rights means any and all intellectual property rights, of all types or nature whatsoever, including, without limitation, patent, copyright, design rights, trade marks, data base rights, applications for any of the above, moral rights, know-how, trade secrets, domain names, URL, trade names or any other intellectual or industrial property rights (and any licenses in connection with any of the same), whether or not registered or capable of registration, and whether subsisting in any specific country or countries or any other part of the world.
    • Judging means the judging of an Entry from the class of total entries by Skill Competition Judges that occurs on the relevant Skill Competition’s Judging Date to determine the Winner and, where applicable, any Runner(s) Up.
    • Judging Date means the date at which the Judging takes place following the Closing Date of the relevant Skill Competition.
    • Mobile Number means the valid mobile telephone number required to be submitted to the Website or App as a minimum in order for a Visitor to become a Registered User.
    • Postal Entry means a validly composed and posted postcard, in accordance with these Terms and Conditions, for entry into a Prize Draw Competition that is received by the Promoter.
    • Prize means the goods or service so specified in respect of each Competition that a Winner or Runner Up of that Competition may receive.
    • Prize Draw Competition means any competition operated by the Promoter on its Website and/or App to which these Terms and Conditions apply, wherein Entrants submit Entries via the Website or App, or submit Postal Entries, for a chance to win one or more Prizes, where the Winners are selected at random from all valid entries.
    • Prize Value means the approximate cash value of a Prize of a Competition, as specified in the relevant Competition description.
    • Product means a good or service provided by a PrizeStars Partner.
    • PrizeStars Account means the area of the relevant User Account where any PrizeStars Ticket(s) that a Registered User may have purchased or, in the case of a Postal Entry, have been allocated to that Registered User, are stored in virtual form and which forms part of their relevant User Account.
    • PrizeStars Partner refers to a company or private individual that enters into an agreement with the Promoter to provide one or more Products.
    • PrizeStars Tickets means the virtual tickets that Registered Users are allocated when they submit an Entry or Postal Entry for a Prize Draw Competition.
    • Promoter means Triple Star Media Limited, incorporated and registered in England and Wales with company number 12568932 and whose registered office address is 4 Claridge Court, Lower Kings Road, Berkhamsted, Hertfordshire, England, HP4 2AF.
    • Registered User means a Visitor that has supplied their required registration information such as mobile number or email or signed in through one of the linked social media platforms such as Facebook or Google.
    • Reserve Level means a certain number of PrizeStars Tickets, which may be specified for a Competition in the description (but is irrelevant if not specified).
    • Runner(s) Up means the Entrant(s) selected second, third, fourth, and so on as required by the Competition on the Draw Date or Judging Date, subject always to the these Terms and Conditions and any specific Competition rules.
    • Runner Up Prize(s) means the Prize that a Runner Up will receive, as may be specified in a Prize Draw Competition or Skill Competition.
    • Shared Competitions means Competitions that can be entered via the Promoter’s other websites as well as the Website, such as Prizestars.com and PrizeJar.com.
    • Skill Competition means any competition whereby the Entrant submits Entries via the Website and/or App and can only obtain a chance of winning a Prize by exercising skill and judgement, which is operated by the Promoter on its Website and/or App to which these Terms and Conditions apply.
    • Skill Competition Algorithm means the mathematical model which takes co-ordinates entered by the Skill Competition Judges as part of the Judging process to calculate the Correct Result.
    • Skill Competition Co-Ordinates Module means the software module used by the Skill Competition Judges to securely enter their x-axis and y-axis co-ordinates for a specific Skill Competition Picture
    • Skill Competition Object means the object which is not in the Skill Competition Picture that the Entrant is required to locate the correct x-axis and y-axis co-ordinates of in order to be the Winner of a Skill Competition.
    • Skill Competition Picture means a picture whereby the Skill Competition Object has been removed from it which the Entrant uses their skill to identify the correct x-axis and y-axis co-ordinates of the Skill Competition Object as part of a Skill Competition.
    • Skill Competition Judges means a minimum of three (3) judges who use their prerequisite level of skill to enter their x-axis and y-axis co-ordinates into the Skill Competition Co-Ordinates Module for a specific Skill Competition Picture in order for the Skill Competition Algorithm to determine the Correct Result.
    • Software means the software required to be accessed or otherwise utilised by an entrant from the Website for the purpose of participating in the Competitions, including any enhancements, modifications, additions, translations or updates to such software.
    • Software Provider means Arama Software Limited of 1D, 1st Floor, Felicity Building, 38 Peel Street, Central, Hong Kong.
    • Start Date means the date on which a Competition opens, as specified in the description of the Competition on the Website or App.
    • Tie Break means the process by which a Winner of a Skill Competition is identified if multiple Entrants selected the Winning Result from the initial Skill Competition Picture.
    • User Account means the Registered User's account maintained with us to enable that person to enter Competitions.
    • Visitor means any unique visitor that is a natural person (not including a limited company, partnership or limited liability partnership) to the Website or App.
    • Website means https://PrizeStars.com and all sub-domains attached to this domain.
    • Winner means the Entrant first selected in a Prize Draw Competition by the Draw on the Draw Date or the Entrant who uses their skill to select the Skill Competition Winning Result in a Skill Competition on the Judging Date, in accordance with these Terms and Conditions of the Competition.
    • Winning Result means the result which is the Correct Result, or closest to the Correct Result in any Skill Competition.
    • You, Your and similar terms mean the Entrant and the user of the Software from the Website.
The Promoter
  1. This Website and App and all Competitions contained therein are operated by the Promoter, and the Promoter is the official sponsor of each Competition, unless specified otherwise. Where the Prize is sourced from a PrizeStars Partner, the Promoter is authorised by that PrizeStars Partner to offer their respective Product(s) as Prizes in the Competitions.
How to Enter
  1. To validly enter a Competition via any entry route a Visitor must first become a Registered User by completing all details required on the Website or App, or signing in through one of the linked social media platforms, and must then:
    1. submit at least one Entry via the Website or App and pay the applicable Entry Fee before the relevant time on the Closing Date of that particular Competition; AND/OR

    2. submit an Entry via the Website or App by redeeming bonus points in accordance with terms 37 to 42 of the Terms and Conditions; AND/OR

    3. for Prize Draw Competitions only, submit at least one Prize Draw Competition entry via the Postal Entry option.

  1. Postal Entries must:
    1. be written in legible English on an unenclosed postcard and sent prior to the Closing Date by first-class stamped mail to the Promoter at PrizeStars, PO Box 8162, Derby, DE1 9GU. Postal Entries without correct and sufficient postage paid will be invalid and will not be considered. Personal and hand deliveries will not be accepted;

    2. be received by the Promoter at the above address no more than three working days after the Closing Date of the particular Prize Draw Competition;

    3. clearly identify the Prize Draw Competition name and ID reference number at the top of the postcard. Attempted Postal Entries received on anything other than a postcard or after the time and date stated above will not be accepted. Only one entry per postcard will be permitted. If multiple entries are received on a single postcard, only one entry will be entered into the relevant Prize Draw Competition. You can submit multiple Postal Entries by sending multiple postcards; and

    4. clearly identify the Entrant’s full name and email address (which must be the same as the email address they have used to create their User Account). If the Entrant's Account cannot be identified from the details provided on the Postal Entry (for example the email address is missing or does not correspond to any Registered User’s User Account), then the Prize Draw Competition-specific single entry will not be processed.

Entrants’ Information
  1. At the time of entry, all Entrants will be required to provide contact details and other personal information for the following purposes:
    1. to notify any Winner or Runner(s) Up that they have won a Prize in a Prize Draw Competition or Skill Competition;
    2. to verify that the Entrant meets the eligibility criteria for entering the Competition; and
    3. to administer the Website and App, and conduct the Competitions.
  2. After a Draw, Winners and Runner(s) Up may be required to provide additional information for the following purposes:
    1. to enable the Promoter to deliver Prizes;
    2. to publish details of the Winner and, where applicable, any Runner(s) Up’s first name, town/county of residence and profile image or other provided photo on the Website and/or App, and in media communications about the Prize Draw Competitions or Skill Competitions (Entrants can object to this by emailing help@prizestars.com
  3. The Promoter will store and process the Entrant’s personal information in accordance with PrizeStars’s Data Protection and Privacy Policy.
  4. The Promoter’s relevant payment providers may require additional information such as the Entrant’s postcode and card payment details. Once the purchase order for the Entry is submitted, the Registered User's card payment will be electronically approved and the Promoter will not retain any records of the Registered User's card details.
  5. All Entrants are solely and completely responsible for providing the Promoter with accurate and current contact details. By entering a Competition, Entrants warrant that all information that they submit is accurate, true, current and complete.
Invalid Entries
  1. Entries and Postal Entries that are submitted before the Competition Start Date or after the Closing Date will be void and will not be eligible to win a Prize.
  2. The Promoter will be in no way liable for any failure or inability to make contact with any Entrant due to any errors, omissions or inaccuracies in the contact details provided by the Entrants or otherwise.
  3. The Promoter will not accept:
    1. responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause including, for example, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    2. responsibility for Postal Entries that are lost, mislaid, damaged, or delayed in receipt at the specified address and within the specified time period in accordance with term 6, and this applies regardless of the cause including, for example, failure of postal service, natural disasters, and water corruption; or
    3. any other purported proof of entry to the Competition other than as recorded by the systems of the Website or App, or by the Promoter upon receipt of a valid Postal Entry.
  4. An Entry and/or a Postal Entry shall be declared void (without any refund being given) if the Entrant engages in:
    1. any form of fraud, whether actual or apparent;
    2. fraudulent misrepresentation;
    3. fraudulent concealment;
    4. hacking or interference with the proper functioning of the Website or App; or
    5. amending, or unauthorised use of, any code that constitutes the Website or App.
  5. Each individual Entrant may submit up to the maximum number of entries specified in total for any one particular Competition, through any combination of Entry/Entries and, in the case of Prize Draw Competitions, a maximum of one Postal Entry.
  6. Only valid Entries and Postal Entries, where relevant, will be entitled to participate in the Competition and be eligible to win a Prize.
  7. All funds deposited to each PrizeStars Account, and all Entries and Postal Entries to any one Competition, are final. Such funds deposited do not represent a withdrawable balance. Refunds shall not be given at any time apart from under the circumstances described in terms 24 and 58.

Eligibility and Disqualification
  1. Competitions are open for entry only to Registered Users who are:
    1. private individuals (i.e., not companies or businesses);
    2. aged 18 (eighteen) or over;
    3. residing in the United Kingdom only; and
    4. not the Promoter or employees of the Promoter.
  2. In entering a Competition, all Entrants confirm that they meet the above eligibility criteria. The Promoter may require any Entrant, including any Winner and/or Runner(s) Up to provide evidence (such as photo ID or proof of address) demonstrating that they are and were eligible to enter a particular Competition in accordance with these Terms and Conditions and Applicable Law before any Prize will be awarded.
  3. The Promoter will not accept and will not refund Entries that are:
    1. automatically generated by computer;
    2. completed by third parties;
    3. fraudulent concealment;
    4. paid for using a debit/credit card belonging to someone other than the Entrant;
    5. altered, reconstructed, forged or tampered with; or
    6. incomplete.
  4. The Promoter will not accept and will not refund the cost of postage of any Postal Entries that are:
    1. completed by third parties;
    2. illegible, have been altered, reconstructed, forged or tampered with;
    3. incomplete;
    4. incorrectly sent by post;
    5. delayed in receipt or not received at the Promoter's specified address in accordance with term 3 of these Terms and Conditions through whatever reason other than the Promoter's actions.
  5. Entries and Postal Entries on behalf of another private individual will not be accepted, and joint submissions are not allowed.
  6. The Promoter reserves the right to permanently close or suspend a Registered User’s User Account (and prevent the individual who created the User Account from participating in any future Competitions under a different mobile number or e-mail) at any time if the Promoter reasonably believes that it is necessary to do so in order to protect the interests of the Promoter and/or other Registered Users and/or to comply with Applicable Laws. Without limiting the preceding sentence, the Promoter shall be entitled to close or suspend a Registered User’s User Account and/or disqualify an Entrant from any Competition(s) that they have entered for which no Draw or Judging has yet taken place if:
    1. the Promoter considers that the Registered User is entering Competitions in an excessive manner;
    2. the Registered User has become bankrupt;
    3. the Promoter considers that the Registered User has used the Website or the App in a fraudulent manner or for illegal and/or unlawful or improper purposes and/or has otherwise breached these Terms and Conditions or Applicable Laws;
    4. the Promoter considers that the Registered User has used the Website or the App in an unfair manner, has deliberately cheated or taken unfair advantage of the Promoter or any of its other Registered Users or if the Promoter reasonably believes the Registered User’s User Account is being used for the benefit of a third party;
    5. the Promoter is requested to do so by the police, any regulatory authority or court; or
    6. the Promoter considers that any of the events referred to above in ‘a.’ to ‘f.’ may have occurred or are likely to occur.
  7. If the Promoter closes or suspends the Registered User’s User Account for any of the reasons referred to in term 23 above, the Registered User shall be liable for any and all claims, losses, liabilities, damages, costs and expenses incurred or suffered by the Promoter arising therefrom and shall indemnify and hold the Promoter harmless on demand for the same. In the circumstances referred to in ‘a.’, ‘b.’, ‘d.’, ‘e.’, ‘f.’ and ‘g.’ (excluding ‘c.’ ) above, the Promoter will refund any Entry Fees paid by the Registered User for Prize Draws in which they are no longer entitled to or able to participate as a result of their account being closed or suspended before the applicable Closing Date.
Prize Draw Competitions and the Draw
  1. For Prize Draw Competitions, Entrants will receive one PrizeStars Ticket for each valid Entry and one PrizeStars Ticket for each valid Postal Entry that they submit.
  2. The Winner and any Runner(s) Up (where applicable) for each Prize Draw Competition will be selected at random from all PrizeStars Tickets that have been purchased or allocated to Entrants to the Prize Draw Competition. The Winner and any Runner(s) Up (where applicable) will be awarded the relevant Prize Draw Competition Prize(s) so specified on the Website and on the App in accordance with these Terms and Conditions and any specific additional terms of the relevant Prize Draw Competition.
  3. The Draw to determine the Winner and, where applicable, any Runner(s) Up will be made on the Draw Date.
  4. On each Draw Date:
    1. there will be a Draw to determine the Winner, and the Prize shall be awarded to the Winner; and
    2. where the Prize Draw Competition provides for one or more Runner Up Prize(s), there will be a Draw or Draws to determine the Runner(s) up, who shall be awarded the associated Runner Up Prize(s).
  5. All Winners and Runners-Up of Prize Draw Competitions will be selected by a random number generator or an alternative verifiably random process. The result(s) of the Draw are final and the Promoter shall not enter into any correspondence in relation to the same.
Skill Competitions and the Judging
  1. “Spot The Object” competitions or similar Skill Competitions may be offered by the Promoter on the Website or App. Unless otherwise stated on the Website or App, these Skill Competitions shall have the following characteristics:
    1. The Entrant is presented with a Skill Competition Picture which excludes the Skill Competition Object; and
    2. The Entrant’s objective is to use their skill to select the x-axis and y-axis points on the Skill Competition Picture which represent the exact central point of where they believe the Skill Competition Judges will determine that the Skill Competition Object was before it was removed.
  2. Judging Process

    1. The “Spot The Object” Judging process using Skill Competition Judges is as follows:
      1. Each Skill Competition Judge independently makes their decision in a specific Skill Competition without being aware of the specific x-axis and y-axis co-ordinates they or the other Skill Competition Judges select;
      2. The Skill Competition Algorithm takes the x-axis and y-axis co-ordinates of the decisions of all the Skill Competition Judges participating to calculate the Skill Competition Correct Result;
      3. If one (1) Entrant uses their skill to select the Skill Competition Winning Result then that Entry shall be deemed to be the Skill Competition Winning Result and they shall be deemed the Winner;
      4. If more than one (1) Entrant uses their skill to select the Skill Competition Winning Result then those Entries shall be deemed the Skill Competition Winning Result and those Entrants shall enter into a Tie Break to find a Winner as follows:
        1. if any Entrant with the Skill Competition Winning Result has made only one (1) Entry into the Skill Competition then all Entrants that have been entered into the Tie Break shall be shown a new Skill Competition Picture and each Entrant shall have one (1) selection to make. The Entrant with the Skill Competition Winning Result shall be deemed to be the Winner. If more than one (1) Entrant selects the Skill Competition Winning Result then this process will continue until a single Winner is identified; or
        2. If all Entrants with the Skill Competition Winning Result have made more than one (1) Entry into the Skill Competition then the Entrant’s whose second-closest Entry was closest to the Skill Competition Winning Result shall be the Winner.
      5. The Skill Competition Algorithm is audited and certified using the Winner Picker software provided by Fonix Mobile of 23 Heddon Street, London, England, W1B 4BQ.
  3. The Skill Competition Judges’ decisions in respect of Skill Competitions shall be final and binding, and no correspondence will be entered into in relation to the same.
  4. Postal Entries for Skill Competitions are not valid and any answers received in this manner will not qualify.
Registered User Bonus Points and Bonus Draw Prize Draw Competitions
  1. In certain circumstances as set out from time to time on the Website and App, Registered Users will be awarded bonus points when validly entering a Prize Draw Competition or completing other requested tasks such as answering surveys or responding to other requests of the Promoter and/or its partners.
  2. The number of bonus points awarded to Registered Users will vary dependent on the route of entry into a Prize Draw Competition or other task being completed, as set out on the Website and App. Unless otherwise set out in the terms of a specific Prize Draw Competition, Postal Entries shall receive one (1) bonus point per valid Postal Entry. Prior to posting the entry in accordance with term 3, the Registered User must email a photograph of the stamped post card entry, completed in accordance with term 3, and email it to help@prizestars.com. The Registered User’s account will then be credited with one bonus point within three working days of the close of the Competition.
  3. Bonus points may be redeemed by Registered Users for entry into certain marked bonus draw Prize Draw Competitions (“Bonus Competitions”) offered from time to time in accordance with the number of points required to enter such Bonus Competition(s), together with any other eligibility requirements, including these Terms and Conditions.
  4. Registered Users may review their bonus points balance in the “Profile” section of the Website/App.
  5. Bonus points are personal, non-transferable and may not be redeemed for any cash value.
  6. Any unused bonus points will automatically expire on the date falling six (6) months after they are awarded. All bonus points shall automatically expire simultaneously (without any value whatsoever) on the closure of a Registered User’s PrizeStars Account, whatever the reason.
Reserve Levels
  1. Unless otherwise specified in the description under a Prize Draw Competition, there is no Reserve Level and the Prize will always be given away as soon as practicable after the Draw Date. If a Reserve Level is specified and not met by the Competition’s Closing Date, the Promoter will, at its sole discretion, either give the Prize(s) to the Winner and any Runner(s) Up, or return all Entry Fees for that specific Competition to the Entrants.
Notification of Winners
  1. If any Winner or Runner(s) Up cannot be contacted by the Promoter within 21 (twenty-one) days of being notified of their status as the Winner by email and/or telephone outlined in the contact details submitted in their Entry or Postal Entry, the Promoter shall be entitled to award their Prize to the Entrant next Drawn, with the effect that the first Runner Up (as applicable) would become the Winner, the second Runner Up (as applicable) would become the first Runner Up, and so on. At the Draw, there shall be such number of additional/reserve entries drawn but not actioned or disclosed until required to permit the operation of this alternate Winner / Runner Up arrangement. Any alternate Winner or Runner Up shall likewise comply with the above 21 (twenty-one) day contact requirement.
  2. In exceptional cases, such as where the Promoter is to award a particularly high-value Prize or suspects that these Terms and Conditions have not been adhered to, the Winner, and where applicable, any Runner(s) Up may be required to forward personal identification to the Promoter to prove their identity, that their Entry or Postal Entry was made in accordance with these Terms and Conditions, and that there is no lawful impediment (pursuant to any Applicable Law) to the Winner or any Runner(s) Up being awarded any Prize in the relevant Competition. In the event that the Promoter reasonably believes that there may be a lawful impediment to awarding a Prize to a Winner or any Runner(s) Up (including a breach of these Terms and Conditions), the Promoter may suspend making such award until the legal issue is resolved or if, in the reasonable opinion of the Promoter such issue cannot be resolved, to award that Prize in a like manner as set out in term 44.
Prizes
  1. In cases where the Prize is an experience, which should be taken to include, for example, domestic and international holidays, day-trips and one-off events or occasions, the Winner of the Prize or any Runner(s) Up will be contacted by either the Promoter or a PrizeStars Partner to arrange delivery of the experience. If the Winner or Runner Up fails to confirm necessary details (e.g. the people who will be attending the experience, the desired date of the experience, etc.) within 14 days from the point of being contacted, then it is acknowledged that, on occasion, certain elements of the Prize may not be available, in which case the Promoter reserves the right to offer a substitute experience of at least equal value as the original Prize.
  2. Unless stated otherwise in the Competition Rules, the Prize does not include travel insurance, the cost of transfers to and from airports, stations or Prize venues, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).
  3. The Promoter does not in any way guarantee or give any warranties as to the value of the Prize, its condition, history or any other matters associated with the Prize. Any images are an illustrative example and do not show the exact Prize(s).
  4. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
  5. Any Prize(s) to be awarded to the Winner and/or Runner(s) Up cannot be substituted for any Prize(s) of equivalent value, such as a cash prize, at the request of the Winner and/or Runner(s) Up. The Promoter reserves the right to offer a cash alternate to the Prize specified in the Competition, and to offer a Prize of equal or greater value if the Prize is no longer available due to circumstances outside the Promoter’s reasonable control.
  6. The Promoter reserves the right to remove a Competition from the Website or App at any time with notice provided on the Website or App, and in the rare event that this occurs, will refund all Entry Fees paid, or the equivalent amount spent on a Postal Entry, to that Competition to the Registered User’s PrizeStars Account.

Announcement of Winners and any Runner(s) Up
  1. The Promoter will announce the Winners and (where applicable) Runner(s) Up of each Prize Draw Competition and Skill Competition on the Website and App and (unless the winner or Runner Up asks the Promoter not to) will publish their first name, town/county of residence and profile image or other provided photo on the Website and/or App. Entrants can ask the Promoter not to publish all or any part of this information from the by emailing help@prizestars.com at any time prior to the relevant Closing Date.
  2. Subject to Registered User’s consent the Promoter may also include this information in email marketing campaigns, as well as on the Promoter’s associated social media pages/sites, such as Facebook, Instagram and Twitter. Any Winner and Runner(s) Up shall be requested to cooperate with and participate in the Promoter’s reasonable publicity requests.
  3. The Competition are not in any way associated with, administered or sponsored by Facebook, Instagram, Twitter or any other third party social media platform.
Software
  1. Entrants are granted a limited, personal, non-transferable, non-exclusive license to access and otherwise utilise the Software on their device, in order to enter any Competitions.
  2. The Promoter and the Software Provider make the Software available to the Entrants on an ‘as is’ basis, without any undertakings, warranties or representations, express or implied, statutory or otherwise.
  3. The Promoter and the Software Provider, hereby exclude and disclaim any and all implied terms, conditions and warranties (including any warranty of merchantability, satisfactory quality and fitness for any particular purpose).
  4. Entrants are not permitted to, and agree not to permit or assist others to:

    1. use, copy, modify, create derivative works from or distribute the Software, any part of it, or any copy, adaptation, transcription, or merged portion of it;
    2. decode, reverse engineer, disassemble, decompile or otherwise translate or convert the Software or any part of it;
    3. transfer, loan, lease, assign, rent, or otherwise sublicense the Software;
    4. remove any copyright, or proprietary notices from the Software;
    5. operate the Software or any part of it for the benefit of or on behalf of any third party;
    6. enter, access or attempt to enter or access or bypass our security system or interfere in any way with the Website or attempt to make any changes to the Software and/or any parts thereof; or
    7. use any Assistance Programs in connection with the Software and/or the Competitions. Entrants are prohibited from any interaction within the Competitions that is not the direct result of them personally utilising the Software for the purpose for which it was intended.
  5. Entrant acknowledges and agrees that the Promoter and/or the Software Provider may take steps to detect and prevent the use of Assistance Programs.
Intellectual Property
  1. Entrant acknowledges and agrees that all Intellectual Property Rights, title and interest in and to the Software, including in and to any modification, enhancement, adaptation, translation or other change of or addition to the Software, belong exclusively to the Software Provider, Entrant agrees not to, directly or indirectly, attempt to invalidate for any reason whatsoever, or assert, or assist the assertion by others, that the rights, title or interest in the Software belong to any third party other than the Software Provider, or that they infringe the Intellectual Property Rights of others.
  2. All trademarks and copyrighted materials presented on or contained within the Website and App (including but not limited to the PrizeStars name and logo) are owned or licensed by the Promoter and may not be used by you without the prior written consent of the Promoter or its applicable licensors.
Limitation of Liability
  1. If the Promoter fails to comply with these terms and conditions, the promoter is responsible for loss or damage you suffer that is a foreseeable result of the Promoter's breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter's breach or if they were contemplated by you and the promoter at the time that the Entrant entered the Competition.
  2. The liability of the Promoter to each Entrant is limited to the aggregate value of the Entry Fees paid by that Entrant to the relevant Competition.
  3. The Promoter and Software Provider accept no liability for errors or omissions contained within the description of any Prize awarded as part of any of the Competitions on the Website or App, or the Prize Value, or any other description or specification or any other part of the Website or App. It is the responsibility of each Entrant (and in particular the Winner and any Runner(s) Up) to satisfy him/herself as to the accuracy of any such details and/or any content of the Website or App.
  4. The Promoter and Software Provider accept no liability for errors or omissions caused by human error or technical faults within the technological infrastructure.
  5. Where the Website or App contains links to other websites, apps or resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
  6. This Website and App is directed to people residing in the United Kingdom only. We do not represent that content available on or through the Website or App is appropriate for use or available in other locations.
General
  1. The Promoter reserves the right to suspend or cancel any Competition at any time, either before or after Entries and/or Postal Entries have been received, and where possible will provide prior notice of the same on the Website or App. If a Competition is cancelled due to the Promoter’s actions and specifically not those of the PrizeStars Partner or any other entity associated to the Competition, the Promoter will return the Entry Fees paid by each Entrant to the Entrant. Where all the Entry Fees have been returned, the Promoter shall have no further liability to the Entrant or to any other person.
  2. Shared Competitions. The Promoter may from time to time operate websites or apps that are similar to the Website and App. Some Competitions can be entered through more than one of the Promoter’s websites or apps. When this happens, all entries to the Competition will be treated equally and will have the same chance of winning the prize(s), regardless of which website/app or entry method is used to submit them. This enables the Promoter to offer the largest possible prizes. If the prize for a Competition is labelled as ‘exclusive’, it means that the Competition is only available on the Website and App and only Entries or Postal Entries submitted in accordance with these terms and conditions will be submitted into the Prize Draw.
  3. Without prejudice to the operation of term 69 above, the Promoter reserves the right to cancel any Competition in the event that an order is made or a resolution is passed for the winding up of the Promoter, or an order is made for the appointment of an administrator to manage the affairs of the Promoter, or circumstances arise which entitle a court or creditor to appoint a receiver or manager or which entitle a court to make a winding up order, or the Promoter takes or suffers any analogous action in consequence of debt or an application to court for protection from its creditors is made by the Promoter. Where possible the Promoter will provide notice of the above on its Website.
  4. The Promoter reserves the right to make reasonable amendments to these Terms and Conditions at any time with notice on its Website in accordance with Applicable Law. Any such amendments shall not prejudice any Entries or Postal Entries received prior to the time of notice of such changes.
  5. The Promoter may transfer its rights and obligations under these Terms and Conditions to another organisation. The Promoter will tell you in writing if this happens and will ensure that the transfer will not affect your rights under the contract.
  6. These Terms and Conditions shall not create or be construed as creating any relationship of agency, joint venture or other agreement between any Entrant and the Promoter.
  7. The Competitions and these Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by English law.
  8. Entrants can bring legal proceedings in respect of the Competition and these terms and conditions in the English courts. Entrants that live in Scotland or Northern Ireland can bring legal proceedings in respect of the Competition and these terms and conditions in either the English courts or the Scottish or Northern Irish courts (as applicable).
  9. As a consumer, each Entrant will benefit from any mandatory provisions of the law of the country in which he or she is resident. Nothing in these terms and conditions, including the term above, affects an Entrant's rights as a consumer to rely on such mandatory provisions of local law.
